Dilley is a family residential center where the average length of stay for families is approximately 20 days, in accordance with the Flores Settlement Agreement. Due to their short stay, the facility cannot accommodate general, non-essential correspondence, such as personal letters, greeting cards, and other non-privileged correspondence from friends or extended community members. However, the facility allows special correspondence, including legal mail. Special correspondence is defined as privileged communication that warrants additional protections to ensure confidentiality and to safeguard the legal and constitutional rights of residents. This includes correspondence to and from private attorneys and other authorized legal representatives; government attorneys; judges and courts; embassies and consulates; the President and Vice President of the United States; Members of Congress; the Department of Justice; the Department of Homeland Security; outside health care professionals; administrators of grievance systems; and representatives of the news media. All incoming special correspondence and legal mail are handled in accordance with established procedures to preserve confidentiality. Legal mail is opened and inspected for contraband in the presence of the resident, but it is not read by the facility staff. This process ensures institutional security and maintains the integrity of privileged communications. Incoming packages are also permitted under the current contract modification. Packages are subject to inspection and screening in accordance with facility security procedures to prevent the introduction of contraband or unauthorized items. Acceptance of packages remains contingent upon compliance with facility guidelines regarding approved vendors, allowable contents, and size limitations. These measures are intended to balance institutional security requirements with the need to maintain access to legal resources, governmental oversight entities, and other protected channels of communication.
